Terms of Service

These terms apply to PicPlots accounts, subscriptions, dream posts, moderation, and support.
How checkout works: PicPlots website purchases use Stripe. An eligible Android build may offer Regular Plot and Featured Top 12 subscriptions through Google Play Billing, but only when PicPlots has enabled Play billing for that build and device. The current production release does not enable contributions or owner-to-owner resale. If either feature becomes available after the required payment, fraud, legal, and store approvals, the additional terms below apply.

PicPlots versions distributed through Apple are also governed by the Apple Standard Terms of Use (EULA).

What PicPlots is

PicPlots is a public vision board for dreams in progress. An active subscription lets you place one approved dream post at the Regular Plot or Featured Top 12 position you selected. A dream post can include one photo, an optional short description, and an optional secure website link.

The subscription is part of the personal commitment. Paying to put a dream somewhere public may make it harder to quietly forget, but PicPlots cannot do the work for you and does not guarantee progress or success.

PicPlots does not offer a prize, giveaway, sweepstakes, winner selection, or program that chooses people for money or help. Posting, paying, sharing, or receiving attention does not promise funding, assistance, customers, views, or any other result.

Subscriptions and billing

What you get

Content rules

Keep it legal and honest. Photos, descriptions, labels, and links must not contain or point to anything illegal, hateful, harassing, sexually explicit, violent, deceptive, infringing, or malicious, including malware, phishing, or scams. Never post content that sexualizes or endangers minors. You must own the content or have permission to use it, including permission from any identifiable person in a photo. Optional links must use HTTPS. We have zero tolerance for objectionable content and abusive users. Every dream post is reviewed before it appears publicly. Any viewer can report a post. Reported content is reviewed and objectionable content is removed within 24 hours. You can block an uploader from your view. We may reject or remove content and may suspend a placement or account that breaks these rules, at our sole discretion and with or without notice. Content rejected or removed for breaking these rules is not refunded. Copyright complaints are handled under our DMCA policy.

Your content

You keep ownership of content you upload. You give PicPlots a non-exclusive, worldwide license to host, copy, resize, display, and distribute that content only as needed to operate, promote, secure, and moderate PicPlots. This license ends when the content is deleted from active systems, subject to reasonable backup and legal-retention periods.

Accounts and eligibility

You must provide accurate account and billing information, protect access to your email account and any Google, Apple, or Facebook account you use to sign in, and be at least 18 years old, or the age of legal majority where you live, to purchase a plot. A provider button creates or signs in to a free PicPlots account and authorizes the provider to share the account information described in the Privacy Policy. Returning users should reuse the same sign-in method. Different provider identities, including an Apple private relay address, may create separate accounts. You are responsible for activity performed through your account.

Contributions and transfers

These features are not enabled in the current production release. Do not use a description or link to misrepresent PicPlots as collecting money for you or operating an off-platform resale.

If and when optional contributions are available, a contribution is a voluntary person-to-person payment to the dream owner shown before confirmation. It is separate from buying, keeping, ranking, or reselling a plot. A contributor receives no ownership right, reward, badge, boost, placement advantage, access, entry, chance of selection, or promise that the stated goal is true or will be completed. A contribution is not a charitable donation unless the recipient independently qualifies and the law says otherwise.

PicPlots charges a 0% platform fee on contributions made through the web, iOS, or Android flow. PicPlots sends 100% of the displayed contribution amount to the recipient's Stripe connected account and absorbs standard payment-processing fees instead of deducting them from that amount. Stripe may apply identity checks, risk reviews, holds, payout schedules, refunds, reversals, or other controls under its terms and applicable law. The amount, recipient, PicPlots fee, and recipient amount must be shown before confirmation.

If and when owner-to-owner resale is legally available through an approved PicPlots service, PicPlots charges a 10% platform fee on the resale price. The buyer and seller must see the price, PicPlots fee, seller amount, and other applicable terms before confirmation. PicPlots may change the server-configured fee for future transactions after notice, but a change does not alter a completed transaction. The current iOS and Android bundles contain no resale checkout. Any native link to a web resale flow remains disabled unless the applicable regional store program permits it and PicPlots completes that program's requirements.

A plot is a subscription-based display position. It is not an investment, security, stored-value product, or promise of financial return. A plot may never gain value. No purchase includes a right to list, sell, gift, or transfer a plot outside an approved PicPlots service.

No refunds

Direct website purchases are final. To the maximum extent permitted by applicable law, PicPlots does not provide refunds or credits for direct website charges, including unused subscription time, content rejected or removed under the content rules, cancellation during a paid period, or dissatisfaction. Duplicate or unauthorized charges are corrected. A purchase billed by Google Play is subject to Google Play's billing, cancellation, and refund rules. Manage or cancel it and request any provider refund through Google Play. Cancellation normally leaves access through the paid period, but a provider-reported refund or revocation can end the related entitlement sooner. Other store-billed purchases follow the billing and refund process of the store that charged you. Nothing in these terms limits rights you have under mandatory consumer-protection law. As-is service and limitation of liability

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We work to keep the board online, but we don't promise uninterrupted or error-free availability. To the maximum extent permitted by law, NIRO CORP and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business, arising from or related to the service; and our total aggregate liability for all claims relating to the service is limited to the greater of $50 or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain warranty exclusions or liability limits, so parts of this section may not apply to you.

Indemnity

You will defend, indemnify, and hold harmless NIRO CORP and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from content you post, your use of the service, or your violation of these terms, any law, or any third-party right.

Chargebacks

If you believe a charge is wrong, contact support first. Honest billing problems get fixed. Initiating a fraudulent or abusive chargeback, such as disputing a charge you authorized and received service for, is a violation of these terms. To the extent permitted by law, we may suspend or terminate the associated account and placements, forfeit associated entitlements, dispute the chargeback with evidence of your consent records, and recover our reasonable costs. Chargebacks that reverse a placement's payment end that placement.

Termination

We may suspend or terminate your access, account, or placements for violating these terms, for fraud or abuse, or where required by law. You may stop using the service and cancel renewals at any time. Sections that by their nature should survive, including the content license, no-refund terms, liability limits, indemnity, chargeback terms, arbitration agreement, and governing law, survive termination.

Binding arbitration and class-action waiver

Please read this section carefully. It affects your legal rights. Any dispute arising out of or relating to these terms or the service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Fulton County, Georgia, with the option to appear remotely, rather than in court. Either party may still bring an individual claim in small-claims court or seek injunctive relief for intellectual-property misuse. You and NIRO CORP each waive the right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. You may opt out of this arbitration agreement by emailing the support address published on the Contact page with the subject "Arbitration opt-out" within 30 days of first accepting these terms. Where mandatory consumer law gives you the right to sue in your local courts, nothing here removes that right.
